Australia represents the arrangements that it has in place to return certain asylum seekers to Indonesia and certain others to PNG as being implementations of protection elsewhere policies, which keep within the bounds of what is permissible under international law.

The question which will be explored in this is whether Australia’s practice in this regard can indeed be characterised as internationally lawful.
